California Rejects Trump Admin. Resolution to Keep Men Out of Women's Sports

This resolution comes after the US Department of Education found California in violation of Title IX for allowing men to use women's facilities and compete in women's sports.

The report stated, "As a result of the noncompliance finding, [The Office of Civil Rights] has issued a proposed Resolution Agreement to [the California Department of Education] and [the California Interscholastic Federation] to resolve their Title IX violations. OCR has offered both entities an opportunity to voluntarily agree to change these unlawful practices within 10 days or risk imminent enforcement action, including referral to the US Department of Justice (DOJ) for proceedings."

If compliant, this would prohibit boys from competing in sports at all schools, K-12, which receive federal funding and "operate interscholastic athletic programs in California," and would protect California's female students.

But California refused to comply. "The CDE respectfully disagree with the OCR's analysis, and it will not sign the Proposed Resolution Agreement," the CDE said in response to the resolution.

"As a result, our state could lose its federal education funding," said California State Rep. Kevin Riley (R) on the State House floor. "The good news is, we don't have to. The state can prevent any loss of funding simply by complying with the department's very reasonable conditions. ... This will simply restore fairness, common sense, and sanity in California."

Congressional legislators, including Rep. Mark Harris (R-NC), are calling for California to lose its federal funding. "If California wants to purposely endanger female athletes, then it shouldn't get federal funding," Harris posted on X.

Federal officials like Education Secretary Linda McMahon expressed their frustrations with the governor. "California has just REJECTED our resolution agreement to follow federal law and keep men out of women's sports." McMahon said on X. "Turns out Gov. Newsom's acknowledgment that 'it's an issue of fairness' was empty political grandstanding."

This comes after an interview with Charlie Kirk where California Governor Gavin Newsom (D) admitted about men in women's sports, "I think it's an issue of fairness. I completely agree with you on that. It is an issue of fairness. I am not wrestling with the fairness issue. I totally agree with you."

California isn't the first state to receive retaliation from the Trump administration. Maine's Democratic governor, Janet Mills, battled the Trump administration in the courts over Title IX violations in April, and she criticized the administration for freezing all non-essential federal funding after she allowed a "6'1", 245-pound man who murdered both his parents and his dog" to be placed in a women's prison.

The nation is keeping its eyes on these issues as the Trump administration pushes not only Maine and California, but also Minnesota and any other state that will take them on. Attorney General Pam Bondi told reporters in April, "I don't care if it's one, I don't care if it's two, I don't care if it's 100—it's going to stop, and it's going to stop in every single state."
